Ticket sales terms and conditions
Article 1: Scope of these Terms
- These terms and conditions apply to customers who apply for tickets (hereinafter referred to as "Target Tickets") for performances (hereinafter referred to as "Target Performances") sold or provided via the website or "Nagasaki Stadium City Official App" operated by Regional Creation Nagasaki Co., Ltd. (hereinafter referred to as "our company") (hereinafter referred to as "Nagasaki Stadium City Official App" alone will be referred to as the "App" and the website and app together will be referred to as the "Sales System"), as well as via telephone, fax, face-to-face, etc.
- To apply for the applicable tickets, you may be required to register as a member in accordance with the "Stadium City Members N team Membership Terms" (hereinafter referred to as the "Membership Terms"). In addition, other people eligible to enter who are attending the applicable performance under the same application as the applicant (including those registered as accompanying persons; the same applies below) may also be required to register as members.
- Any person applying for a Ticket (hereinafter referred to as the "Applicant") will be deemed to have accepted these Terms and Conditions at the time of applying for the Ticket.
Article 2: Sales and supply method
In addition to being the organizer of a performance, our company may also be entrusted with the sale of tickets based on instructions from organizers other than our company regarding sales methods, and may place restrictions on the number of tickets sold or the sales method as necessary.
Article 3: Application and Contract Formation
- Applicants must apply for the applicable tickets in accordance with the various conditions set forth by our company, such as the type of seat, price, and maximum number of tickets that can be applied for, as well as after agreeing to the notes, as stated on the page for each applicable ticket. The purchase or provision contract will be established upon completion of the application procedure. However, if tickets are purchased by lottery, the purchase or provision contract will be established when the applicant and the person eligible to enter complete the procedures separately set forth by our company after the winning notice is received.
- Depending on the performance, seats may be confirmed at the time or after the ticket is issued, and you may not be able to specify your seat.
- If the number of tickets sold reaches the limit, even during the ticket sales period, the sale of tickets for that event will end. However, if the event organizer decides to add additional seats or hold additional events, the sale may resume.
- Once an application has been made, the applicant cannot withdraw his/her application for the purchase or supply contract of the Target Ticket, unless otherwise specified in these Terms and Conditions or on the page for each Target Ticket.
- For these performances, we will check the name and other information displayed on the ticket and the membership information in the sales system upon entry to confirm that it matches the name and other information listed on the identification of customers entering the venue. If we are unable to confirm this identity, you may be denied entry (or asked to leave if you have already entered).
- Our company may collect information such as the telephone numbers of the applicant and the eligible attendees in cases where the ticket is a specified performance ticket (as defined in the "Act on Ensuring Proper Distribution of Performance Tickets by Prohibiting the Illegal Resale of Specified Performance Tickets, etc." The same applies below) or where it is necessary to verify identity as described in the previous paragraph. In such cases, if the applicant and the eligible attendees change their registered telephone number or other information, they may not be able to enter the performance, etc. related to the ticket, so the applicant and the eligible attendees must keep that information valid until the time of entry.
Article 4: Handling when the target ticket is selected by lottery
- Applicants and/or eligible persons will be notified of their winnings by email and/or push notification on the app to the email address they registered.
- If, after receiving notification of your winning, you do not complete the necessary registration in the manner specified by us by the deadline specified by us, your winning may be invalidated.
Article 5: Payment
- Applicants must pay the ticket price by the date and method specified separately by our company.
- Depending on the ticket, additional fees such as various handling fees and delivery charges may be charged.
- We cannot accept any cancellations or changes after payment has been made.
Article 6 Cancellation of application or invalidity of contract
- If our company or the event organizer determines that any of the following items apply, the application of the applicant and the person eligible to enter the event may be canceled. In addition, even if a contract for the purchase or provision of tickets has been concluded, the contract will be invalidated. In this case, the price of the applicable ticket paid will not be refunded. Furthermore, no compensation will be provided for any travel or accommodation expenses incurred.
- If there is an intention to resell or transfer
- If there are multiple applications from the same applicant, or if the same mobile phone number is specified as the ticket issuing address for multiple tickets, there is a suspicion that the purpose is to resell or transfer the tickets.
- If the address of the applicant and the person eligible to enter is a corporate office
- If the applicant or person eligible to enter does not exist or is suspected of not existing
- If there are any false statements, errors, or omissions in the information declared by the applicant or the person eligible to enter
- Any other case in which the Company has reasonable grounds for determining that the application is inappropriate.
- Below are some examples of when we will refuse entry to a performance. Regardless of whether the following applies or not, if you are unable to present the applicable ticket, we will refuse entry to the performance. In this case, we will not refund any of the paid ticket price. Furthermore, we will not provide any compensation for any travel or accommodation costs incurred.
- If you are unable to present the applicable ticket
- If you are unable to receive necessary communications from us, such as notification of winning, due to incorrect membership registration information or the information declared by the applicant or admission qualification holder, or due to settings that prevent push notifications from being received, etc.
- If your ticket is damaged or lost, etc., and the event organizer is unable to determine whether or not you are permitted to enter the venue
Article 7: Ticket Delivery
- In principle, tickets will be electronic tickets displayed on the app (some tickets may be paper tickets at the discretion of our company or the event organizer), and if the ticket is paid, it will be issued promptly after payment has been confirmed. If the ticket is free, it will be issued by a date determined separately by our company.
- We will not reissue tickets under any circumstances (loss, theft, damage, etc.).
- When applying to purchase tickets, you may be able to select your preferred delivery method from the delivery methods designated by our company for each event. For some events, you may not be able to select the delivery method when applying to purchase tickets, but may be able to select it after applying. In addition, our company may change the delivery methods available.
- Applicants and Eligible Parties will not be able to receive their tickets after the delivery period specified by our company has passed. After the period during which the delivery method can be changed specified by our company has passed, the delivery method cannot be changed under any circumstances. Our company may change the delivery period and the period during which the delivery method can be changed within a reasonable range.
- If you have selected delivery of paper tickets, and the tickets have exceeded the storage period at the post office or delivery company, or if there are inaccuracies in the membership registration details such as the address and name of the registered applicant and eligible attendee, and the tickets cannot be delivered, our company may re-deliver the tickets. In that case, you will be required to pay a re-delivery fee separately set by our company. However, our company is not obligated to re-deliver the tickets. If you have not received the tickets one week after the scheduled delivery date, please contact us.
- If you choose to collect your paper ticket in-store, you must issue and collect the ticket by the deadline specified by us, using the method specified by us.
- Even if a delivery method has been selected, the Company may cancel that selection and require the Applicant and Eligible Entrant to select a new delivery method. In such cases, it may not be possible to select the delivery method that was initially available.
Article 8: Expiration of tickets, etc.
- If our company or the event organizer determines that the applicable ticket falls under any of the following items, the applicable ticket may be invalidated and the person may be denied entry to the venue of the applicable performance (hereinafter referred to as the "Venue") or asked to leave.
- In cases falling under Article 6 or Article 9
- When the information is resold or transferred, such as being put up for auction on the Internet
- If the item is intended for resale or scalping
- When offered as a gift for sales promotion etc.
- If you purchase an eligible ticket with the intention of receiving a refund
- Repeated requests to purchase tickets that you have no intention of purchasing
- If you have paid money or some other consideration to obtain the applicable ticket
- If it is otherwise sold, transferred or provided
- If you refuse to present a document for identity verification (such as a photo ID, such as a driver's license) when asked to identify yourself upon entry
- If the result of identity verification indicates that the person who won the ticket cannot be identified
- If the operation or execution of the target performance is disrupted by any means
- If your membership is suspended for any other reason, such as for violating the terms and conditions of membership.
- In the event that the above applies, ticket prices etc. will not be refunded. Furthermore, no compensation will be given for any travel or accommodation expenses incurred.
Article 9: Prohibited acts
- Our company or the event organizers prohibit applicants and those eligible to enter from engaging in any of the following acts:
- Bringing in any equipment for the purpose of recording, filming, or taking photographs into the venue and engaging in such activities
- Smoking (including e-cigarettes) outside designated smoking areas
- Bringing alcoholic beverages, food and drinks other than plastic bottles and paper drinks into the venue
- Bringing in chairs, bottles, cans, fireworks or other explosives, firearms, pets, bicycles, strollers or other vehicles, or any other items prohibited by law
- Leaving trash inside and around the venue
- Actions that go against the instructions of venue staff
- Selling or purchasing merchandise or photographs or videos illegally taken near the venue
- Excessive stalking or slander against performers, etc.
- Any behavior that causes inconvenience to other visitors or residents living near the venue.
- Any other conduct that the Company or the event organizer deems inappropriate
- If the applicant or the person eligible to attend commits any of the acts listed in the preceding paragraph, the applicable ticket will be invalidated, and the applicant or the person eligible to attend will be refused entry to the venue or asked to leave. In this case, the ticket price will not be refunded. Furthermore, no compensation will be provided for any travel or accommodation expenses incurred.
Article 10: Measures against violators
- Anyone who violates these terms and conditions may, at our discretion, be denied application for any tickets sold by us or the Japanet Group, and may be stripped of their app membership.
- If an Applicant or Eligible Admission Person transfers the Ticket to a third party, the ticket will become invalid in accordance with Article 8 of these Terms and Conditions, and the third party to whom the ticket is transferred, as well as the Applicant or Eligible Admission Person who made the transfer, will be deemed to have violated these Terms and Conditions and will be subject to the provisions of the preceding paragraph.
Article 11: Handling of Personal Information
- The personal information provided to us when applying for the applicable tickets will be used for the following purposes:
- To sell and provide tickets handled by our company, including confirmation of applications, lotteries, and ticket issuance
- Services incidental to the above (such as notifications by email, post, or telephone regarding changes, cancellations, additional sales, or next sales of performances, as well as contact for confirmation deemed necessary for business purposes)
- Sales and promotional activities, such as providing information about our services and advertising the products and services of companies that we deem appropriate
- For identity verification and authentication services
- Conducting surveys and giveaways
- Marketing research, statistics and analysis
- To deliver advertisements and check their results
- System maintenance, troubleshooting, providing technical support, and responding to other customer inquiries
- Important notices, such as changes to our terms, conditions, and policies
- Developing, providing, maintaining and improving our apps, websites, services, content and advertising
- Developing and providing targeted advertising for our or third parties' products or services
- Prevent fraudulent or potentially illegal activities, and other activities that violate the Terms of Use, etc.
- For other uses necessary for carrying out the target performance
- We will not share or provide your personal information to third parties, except with your consent or in any of the following cases: If we provide your personal information to a third party, we will instruct the third party to maintain the confidentiality of the disclosed information and not to use your information for purposes other than those specified by our company.
- Event organizers (including the organizers, management companies, and performers' agencies, etc.) may provide the following to customers and ticket users who purchase tickets through this service:
(ⅰ) To notify you of cancellations, postponements, changes to content, etc. of performances and to handle the associated refund procedures.
(ii) To verify your identity when exchanging tickets and entering the venue.
(iii) To provide information about the performances, products, and services offered by the event organizers
(ⅳ) For the event organizer to contact customers who have violated these terms and conditions.
We may provide all or part of the personal information of customers and ticket users (such as name, address, telephone number, email address, etc.) to the performance organizer. - For customers who have been issued an affiliated credit card by a credit card company affiliated with our company (hereinafter referred to as the "affiliated card company"), our company may provide all or part of your personal information (such as name, address, telephone number, email address, etc.) to the affiliated card company in order for the affiliated card company to provide the basic functions and additional services of the affiliated credit card, and to conduct market research and product development for the affiliated card company and affiliated stores, etc.
- Personal information collected from customers by the Company may be provided to the payment processing service company used by the Company and the card issuer used by the customer in order for the card issuer to detect and prevent fraudulent use. If the customer uses a card issued by a card issuer located in a foreign country, this information may be transferred to the country to which the card issuer belongs. The transfer destination will vary depending on the card issuer used by the customer, so the Company cannot specify the foreign country to which personal information will be transferred. For this, please check the address of the issuer of the card used by the customer.
- We provide your information to third parties who provide services on our behalf, such as data analysis, email sending, identity authentication services, hosting services, and customer service, or who provide services such as payment processing, or who support our marketing.
- We may provide user information to the operator of an external service such as Twitter, Google Account, or other external service when linking with the service or when authenticating the use of the service.
- Our company,
① Specific technical information (including IP address and device ID),
②Statistical information that does not identify individuals,
③We may share non-personally identifiable information about the use of our services with third-party advertisers. You agree that we or the third-party advertisers may use such information for customer trend analysis, demographic analysis, web analysis, and for the purpose of serving you with behaviorally targeted advertising. - For the purpose of preventing the spread of infectious diseases such as the new coronavirus, we may provide your information (which may be personal information) to performance organizers, public health centers, medical institutions, relevant public institutions, etc.
- Event organizers (including the organizers, management companies, and performers' agencies, etc.) may provide the following to customers and ticket users who purchase tickets through this service:
- The handling of other personal information shall be in accordance with Chapter 5 "Member Information" of the "Stadium City Members N team Membership Terms and Conditions" separately stipulated by our company.
Article 12 Compensation for Damages
- Applicants and persons eligible to enter shall be liable to compensate for any damages they cause to our company, the event organizers or a third party due to reasons attributable to them.
- If an applicant or an eligible person receives a complaint or demand from other applicants, other participants in the performance, or other third parties, or if a dispute arises, the applicant or the eligible person shall resolve such complaint or demand at their own responsibility and expense.
Article 13 Use of portrait rights
The performance may be reported in various media such as television, magazines, and newspapers, and may also be filmed and distributed for the purpose of use in commercials, advertisements, internet sites, etc. of our company, our group companies, event organizers, etc. Applicants and those eligible to attend the performance agree that their portraits, including their appearance, may be processed and edited, and that they may be filmed and distributed free of charge.
Article 14: Disclaimer and Refunds
- We shall not be liable for any damages incurred by applicants and persons eligible to enter in connection with the sales system and the application and use of the applicable tickets, except in cases where such damages are caused by our intentional or negligent acts.
- When participating in a target event where our company or our group companies are the event organizers, the applicant and the person who is eligible to enter are responsible for all accidents, injuries, theft or loss of personal belongings that occur on the way to and from the venue, and during the event or on the venue premises, and our company or our group companies, as the event organizers, shall not be held responsible in any way. Please understand all risks associated with participating in the target event (natural disasters, effects of bad weather, traffic troubles, troubles with other participants, etc.) before participating. In addition, if our company or our group companies are the event organizers, we will store any lost or forgotten items found at the venue for a certain period of time, but if the owner does not show up or does not come to pick it up even after contacting us, we will dispose of them. However, items that are difficult to store for a long time (food and drink, items that are deemed inappropriate for hygiene management, etc.) will be promptly disposed of. Valuables may also be reported to the police regardless of the storage period.
- The target event may be canceled in the event of force majeure, such as natural disasters, bad weather, power outages, epidemics or infectious diseases, requests to cancel by public authorities, or unforeseen accidents involving performance participants. In the event of a performance being canceled due to force majeure, refunds will be made only within a specified period based on the decision of the event organizer. However, in this case, if the ticket is damaged or lost, no refunds will be made. Furthermore, only the ticket price will be refunded, and no compensation will be made for any travel or accommodation costs incurred.
- If the applicable event is canceled, please contact the event organizer regarding postponement, rescheduling, refunds, etc. The event organizer will notify applicants and those eligible to attend if the event content is changed or canceled, and if our company is not the event organizer, we will not be held responsible for any changes or cancellations to the event. Therefore, refunds due to changes or cancellations to the event content will not constitute a defense against our company when various payment methods are used. However, our company may handle refunds for tickets sold based on the decision or request of the event organizer due to changes or cancellations to the event content.
- When the Company is commissioned by a performance promoter to carry out refund procedures, the procedures will be carried out in a manner separately specified by the Company.
Article 15: Changes to Terms and Conditions, Acceptance
- In the following cases, we reserve the right to add to, delete from, modify or otherwise change these Terms and Conditions at our discretion without obtaining the consent of the Applicant or Eligible Visitor.
- When the changes to these Terms and Conditions are in the general interest of users.
- When the change to these Terms and Conditions does not contradict the purpose of the contract and is reasonable in light of the necessity for the change, the appropriateness of the content after the change, the content of the change, and other circumstances related to the change.
- When making the above changes to these Terms, the Company will notify customers by displaying the fact that these Terms are being changed, the content of the changed Terms, and the effective date of the changes on the sales system, or by other appropriate means. The changed Terms will come into effect as of the effective date mentioned above. The changed Terms will apply to users who use the Service after the changes to these Terms come into effect.
Article 16 Severability
- Even if any provision of these Terms and Conditions is deemed invalid based on laws and regulations, the other provisions of these Terms and Conditions shall remain valid.
- Even if any provision of these Terms and Conditions is invalid or canceled with respect to a certain user, these Terms and Conditions shall remain valid with respect to other users.
Article 17: Governing Law and Jurisdiction
- The application and interpretation of these Terms and Conditions shall be governed by Japanese law.
- In the event that a lawsuit arises between the Applicant and the Eligible Entry Person regarding these Terms and Conditions, the Applicant and the Eligible Entry Person shall agree that the Tokyo District Court or the Tokyo Summary Court shall be the exclusive court of first instance with jurisdiction, depending on the amount of the claim.
