Accommodation Terms and Conditions
(Scope of application)
Article 1
- All accommodation contracts and related contracts to be concluded between this hotel and guests shall be subject to these terms and conditions.
- In addition to the "Stadium City Hotel Nagasaki Rules of Use" (hereinafter referred to as "Rules of Use") separately stipulated in relation to the accommodation contract, if there are any usage guidelines and notes, etc. (hereinafter referred to as "Guidelines, etc.") presented to customers by the hotel, such Guidelines, etc. shall be considered as part of these Terms and Conditions. (Hereinafter, these regulations, terms of use and Guidelines, etc. shall be collectively referred to as "Terms, etc.")
- When using the services provided on the Stadium City official website and app, in addition to these terms and conditions, the "Stadium City Members N team Membership Terms" and other terms or conditions (collectively, "Other Terms of Use") apply. Please carefully read these terms and conditions and other terms of use before using the service.
- Your personal information will be handled in accordance with our separately stipulated "Initiatives for Personal Information Protection."
- Any matters not provided for in these terms and conditions shall be governed by laws, regulations or generally accepted practices.
- In cases in which the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws, regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence over the provisions of the preceding paragraph.
(Application for accommodation contract)
Article 2
- A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
- Guest's name, address, telephone number, gender, age, date of birth, etc.
- Date of stay and expected arrival time
- Accommodation fees (in principle based on the basic accommodation fees in Appendix 1)
- "Consent form for minors to stay at the hotel" [If the person staying at the hotel is a minor (under 18 years old)]
- Other particulars deemed necessary by the Hotel
- If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, the Hotel will treat it as if he/she had made an application for a new Accommodation Contract at the time such request was made.
(Conclusion of Accommodation Contracts, etc.)
Article 3
- An accommodation contract shall be deemed to have been established when the Hotel accepts the application as described in the preceding article (hereinafter, the guest after the contract has been established shall be referred to as the "Guest"). However, this shall not apply when the Hotel proves that it has not accepted the application, or when the Hotel has refused to conclude the accommodation contract or cancelled it in accordance with these terms and conditions even after the contract has been established.
- When an Accommodation Contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, limited to the basic accommodation charges for the entire stay, shall be paid by the date designated by the Hotel.
- The application fee will first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Article 6 apply, it will be applied in the order of penalty charges and compensation, and the remainder, if any, will be refunded at the time of payment of the accommodation fee as provided for in Article 13.
- If the application fee stipulated in paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the Accommodation Contract shall become void. However, this shall only apply if the Hotel has so informed the Guest when specifying the due date for payment of the application fee.
- If the person seeking accommodation is a minor (under 18 years of age), the application for an accommodation contract will be accepted only when the application described in the previous article is made or when a "Consent Form for Minor's Accommodation" is submitted by a legal representative (parent or other legal guardian or guardian of the minor).
(Special Agreement Requiring No Application Fee)
Article 4
- Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.
- If the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and/or has not specified the due date for the payment of the application fee at the time of accepting the application for an Accommodation Contract, it will be treated as if the Hotel has accepted a special contract as stipulated in the preceding Paragraph.
(Refusal to conclude an accommodation contract)
Article 5
The Hotel may refuse to enter into an Accommodation Contract under any of the following cases:
- When the hotel is fully booked and there are no rooms available
- When the person seeking accommodation is deemed to be in danger of engaging in conduct that violates the provisions of the law, the public order, or good morals in regard to his/her accommodation
- When the application information is not registered as required by Article 8, Paragraph 1
- When there is or is likely to be a false statement in the registration information under Article 8, Paragraph 1
- When the person seeking accommodation is deemed to fall under any of the following (1) to (4):
- An organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Article 2, Paragraph 6 of the same Law (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
- When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
- A corporation in which any of its directors is a member of an organized crime group
- When a person has engaged in any act that displays the power of organized crime groups or aids or encourages such actions.
- When the person requesting accommodation is drunk or behaving in a manner that is, or may be, a nuisance to other guests or third parties
- When the person seeking accommodation is clearly recognized as carrying an infectious disease or is in danger of doing so
- When a person seeking accommodation has engaged in violence, threats, extortion or intimidating unreasonable demands against the accommodation or the accommodation staff (employees), or has requested an unreasonable burden, or is deemed to have engaged in similar conduct in the past, or when there is a risk of such conduct.
- When the person requesting accommodation is a minor (under 18 years of age) and has not submitted a "Consent Form for Minors' Accommodation" by their legal representative (parent or other legal guardian or minor's guardian);
- When it is impossible to provide accommodation due to natural disasters, breakdown of facilities or equipment, or other unavoidable reasons
- When a guest disrupts the operation of the Hotel or damages the reputation and brand of the Hotel or the Japanet Group through the removal of Hotel equipment, other demands that exceed the scope of socially acceptable standards, slander, libel, or intimidation of staff, or harassment such as posting on social media with the intent of causing controversy, or when a guest is deemed to have previously engaged in similar behavior, or when there is a risk of such behavior.
- When the act is contrary to public order and morals, a criminal act, or a violation of laws and regulations, or there is a possibility of such.
- When there are reasons specified by laws, regulations, national guidelines, or prefectural ordinances.
- When this Agreement or other terms of use are violated
- Any other reason that the Hotel deems inappropriate
(Guest's Right to Cancel Accommodation Contract)
Article 6
- A Guest may cancel the Accommodation Contract by notifying the Hotel.
- In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the event that the Hotel has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2 and the Guest cancels the Accommodation Contract prior to such payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has entered into a special agreement as set forth in Article 4, Paragraph 1, this shall apply only when the Hotel has notified the Guest of the obligation to pay the penalty in the event that the Guest cancels the Accommodation Contract, in accordance with such special agreement.
- If a Guest does not arrive by 11:00 p.m. on the day of the stay without contacting the Hotel (or by two hours after the expected arrival time if the Guest has been informed of such time in advance), the Hotel may regard the accommodation contract as having been cancelled by the Guest.
- The provisions of the preceding paragraphs shall not prevent the Hotel from claiming damages from you.
(Hotel's Right to Cancel Contract)
Article 7
- The Hotel may cancel the Accommodation Contract under any of the following circumstances:
- When any item in Article 5 (excluding item 1) applies
- When the User does not comply with the Terms of Use as set forth in Article 10
- When the prohibited acts set forth in Article 11 are committed
- When payment is not made as provided for in Article 13, Paragraph 2
- When a guest attempts to stay or use the accommodation more than the number of guests specified in the accommodation application.
- When a guest commits an act that is dangerous to fire and disaster prevention, such as smoking in bed or damaging firefighting equipment.
- When you do not follow the instructions of the hotel manager or staff
- The provisions of the preceding paragraph shall not prevent the Hotel from claiming damages and penalties from the Guest.
(Accommodation registration)
Article 8
- On the day of your stay, you will be required to register your application details at the Hotel front desk in accordance with Article 2.
- If the Guest intends to pay the charges stipulated in Article 13 by any means other than currency, such as credit card, he/she shall present such means in advance at the time of registration stipulated in the preceding Paragraph.
- When using the Hotel, in addition to the provisions set forth in these Terms and Conditions and other Terms of Use, we may require you to present an official form of identification to verify your identity.
- Please note that for foreign guests who do not have an address in Japan, in addition to providing your name, address, occupation, etc., we will require the presentation and copy of your passport, as well as your nationality and passport number.
(Guest room occupancy time)
Article 9
- Guests may occupy the hotel guest rooms from 3:00 p.m. to 11:00 a.m. the following day. However, in the case of consecutive stays, guests may occupy the guest rooms all day, except on the days of arrival and departure.
- Notwithstanding the provisions of the preceding paragraph, the Hotel may permit the use of the guest room outside the hours specified in the same paragraph. In such cases, the following additional fees shall be charged. However, if there is no availability of rooms, the Hotel may refuse the request even if the Guest makes such a request.
- Up to 3 hours over, 1/3 of the room rate
- Up to 6 hours overage: 1/2 of the room rate
- For over 6 hours, the full room rate will be charged
(Observance of the rules of use)
Article 10
In addition to the Hotel Usage Regulations, the Hotel also has usage regulations in place for each facility according to its facilities. Guests are requested to read these regulations as well as these terms and conditions before using the Hotel.
(Prohibited acts)
Article 11
- The following actions are prohibited in our hotel:
- Registering or providing false information when using the Hotel
- Using the hotel through fraudulent use of payment methods such as credit cards
- Unlawfully obtaining or using personal information of a third party
- Using the hotel for business purposes, regardless of the purpose.
- Making a large number of hotel reservations and then canceling them, or any other similar actions
- Repeatedly making and canceling hotel reservations without a valid reason, or any other similar actions
- Any act of impersonating our hotel or the Japanet Group, or any act that may be misleading
- Unauthorized access to systems or other computers, or any similar actions
- Sending or posting harmful computer programs, etc., or any other similar actions
- Actions that disrupt the operation of the Hotel or damage the reputation and brand of the Hotel or Japanet Group, such as removing Hotel equipment or making other demands that exceed the scope of socially accepted standards, slandering, libeling, or intimidating staff, or harassment such as posting on social media with the intent of causing controversy, or actions similar to these
- Violence, intimidation, blackmail or other intimidating unjust demands against the Hotel or its staff
- Any action that causes or may cause inconvenience, damage or disadvantage to other guests, other third parties, the Hotel or Japanet Group
- Any act that infringes or may infringe on the copyrights, trademarks, other intellectual property rights, privacy rights, personality rights, or other rights of other customers, other third parties, the Hotel, or Japanet Group
- Any act that is contrary to public order and morals, a criminal act, or a violation of laws and regulations, or any act that may be likely to be such.
- Acts that display the power of organized crime groups or that aid or encourage such actions
- Any act violating other provisions of these Terms and Conditions, etc.
- Any other actions that violate the terms of use, etc.
- Any other actions that the Company deems inappropriate
- If damage is caused to the Hotel as a result of the preceding paragraph, the Hotel shall be able to compensate the Guest for such damage.
(Business hours)
Article 12
The opening hours of the main facilities of the Hotel will be announced in the pamphlets provided, on notices posted in various locations, in the service directories in the guest rooms, etc.
(Payment of fees)
Article 13
- The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
- The accommodation fees, etc. as stipulated in the preceding paragraph shall be paid at the front desk at the time of the Guest's departure or when requested by the Hotel by accommodation coupons, credit cards or any other means acceptable to the Hotel.
- If the accommodation fee settlement stipulated in the preceding paragraph is not fulfilled, we will not be able to accept your accommodation registration, services associated with your stay, or applications to extend your stay period.
- Accommodation charges will be charged even if the Guest voluntarily does not utilize the guest room after the Hotel has provided it to the Guest and made it available for use.
- In the case of an accommodation plan inclusive of breakfast, lunch and dinner or additional services provided by the Hotel, the amount of those services will be charged even if the Guest does not eat or use those services.
Article 14 (Liability of the Hotel)
- The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or non-fulfillment of the Accommodation Contract, unless such damages have been caused by reasons beyond the Hotel's control.
- Our hotel is covered by hotel liability insurance to cover the unlikely event of a fire or other incident.
Article 15 (Handling When Contracted Rooms Cannot be Provided)
- When the Hotel is unable to provide a contracted room to a Guest, it will, with the Guest's consent, arrange accommodation of similar standards elsewhere for the Guest, wherever possible.
- Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange alternative accommodations for the Guest, the Hotel shall pay the Guest a compensation fee equivalent to the breach of contract charges, which shall be applied to the reparations. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay the compensation fee.
Article 16 (Handling of Deposited Items, etc.)
- When loss, breakage or other damage occurs to goods, cash or valuables deposited at the front desk by the guest, the hotel shall compensate for such damage, except in cases where such loss or breakage is due to acts of God. However, in the case of cash and valuables, if the hotel requests a declaration of their type and value and the guest fails to do so, the hotel shall compensate for such damage up to a maximum of 100,000 yen.
- The Hotel shall compensate for damages incurred when loss, breakage or other damage occurs due to the Hotel's intention or negligence regarding goods, cash or valuables brought into the Hotel by a guest but not deposited at the front desk. However, for items for which the guest has not reported the type and value in advance, the Hotel shall compensate for such damages up to a maximum of 100,000 yen, except in cases where the Hotel is guilty of intention or gross negligence.
- Please note that the hotel reserves the right to refuse to accept fragile items such as works of art and antiques, perishable goods, and pets.
Article 17 (Care of Customer's Baggage or Belongings)
- If a guest's baggage arrives at the hotel prior to their stay, the hotel will store it responsibly only if the hotel has agreed to this before the guest's arrival, and will hand it over to the guest at the front desk when the guest checks in. If the hotel is unable to inform the guest of the date of stay and the guest's name in advance, or to confirm a reservation, the hotel will refuse to accept the baggage that arrives, or will return it to the sender, and will not accept the baggage.
- If a guest's baggage or belongings are found left behind at the Hotel after checking out, the Hotel will store them for a certain period of time, depending on the nature of the items, and if there are no instructions from the owner during that time or if the owner is unknown, the items will be stored at the Hotel for a certain period of time from the date they were found, after which they will be handled in accordance with the Lost Property Act. In addition, if the Hotel does not hear from the guest by the day after check-out, the Hotel will dispose of food, beverages, magazines, and other items that are considered waste, or items that the Hotel determines to be in accordance with general customs, at its discretion.
- The Hotel reserves the right to inspect the contents of any baggage or personal effects left behind in order to properly dispose of them according to the nature of the items and, if necessary, to return them to the owner or dispose of them in accordance with the preceding paragraph, and the Guest cannot object to this.
- The Hotel's liability regarding the custody of the Guest's baggage and belongings in the cases of Article 1 Paragraphs 1 to 3 shall be in accordance with the provisions of Article 1 Paragraph 2 in the case of Paragraph 1, and in the case of Paragraph 2, in the case of Paragraph 3.
- If a guest's baggage or belongings are found left behind at the hotel after checking out, the hotel will, in principle, handle them in accordance with the Lost Property Act. However, the hotel shall not be liable for any effects resulting from the storage of the items, such as the method and place of storage, or the value of the items, except in the case of intentional or negligent acts that are reasonably causal.
Article 18 (Liability for Parking)
When a guest uses the hotel's parking lot, regardless of whether the key to the vehicle has been deposited with the hotel, the hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the hotel causes damage through intentional or negligent acts on the part of the hotel in managing the parking lot, the hotel will be liable to pay compensation.
Article 19 (Customer Responsibilities)
When the Hotel suffers damage caused through intention or negligence on the part of the Guest, the Guest will compensate the Hotel for the damage.
Article 20 (Disclaimer)
The Company shall be exempt from liability if the case falls under any of the disclaimers set forth in separate provisions of these Terms and Conditions, etc. or other terms of use, etc.
Article 21 (Changes to these Terms and Conditions)
- Please note that the contents of these terms and conditions may be changed without notice. Please check the latest information published on the official website of our hotel.
- If a customer uses the hotel after the contents of these Terms and Conditions have been changed, the customer will be deemed to have agreed to the changes.
- Notwithstanding the preceding paragraph, the provisions prior to the change shall apply to accommodation contracts that were established prior to the change to these terms and conditions.
Article 22 (Severability)
- Even if any part of these Terms, etc. or other terms of use is determined to be invalid based on laws and regulations, the provisions of these Terms, etc. and other terms of use, etc. excluding such part shall remain valid.
- Even if any part of these Terms, Etc. or other terms of use, Etc. is invalidated or cancelled in relation to a particular customer, these Terms, Etc. and other terms of use, Etc. shall remain valid in relation to all customers other than the said customer.
Article 23 (Governing Law)
- The validity, interpretation and performance of these Terms and Conditions shall be governed by the laws of Japan.
Article 24 (Preferred Language)
- The official text of these Terms and Conditions and other terms of use shall be in Japanese. Even if there is a translation provided for your reference, only the original Japanese text shall be valid as a contract, and the translation shall have no effect whatsoever.
Article 25 (Court of Jurisdiction)
- Any disputes arising from these Terms and Conditions shall be submitted to the Tokyo District Court as the court of first instance with exclusive jurisdiction.

(Note)
- The percentage is the ratio of the penalty to the reservation amount (tax included).
- If the number of contract days is shortened, a penalty for one day (the first day) will be charged regardless of the number of days shortened.
- If a contract is terminated for part of a group (15 or more people), we will not charge a penalty for the number of people that is 10% (rounded up to the nearest whole number) of the number of guests staying 10 days prior to the stay (or the day of acceptance if the application is accepted after that day).
