TERMS AND CONDITIONS FOR ACCOMMODATION CONTRACTS

Article 1 (Scope of Application)

  1. The accommodation contract entered into between the Hotel and the Guest, and any related contracts, shall be governed by this Terms and Conditions.
  2. In addition to the “Stadium City Hotel Nagasaki Rules of Use” (hereinafter referred to as the “Rules of Use”) separately stipulated for the accommodation contract, if there are any other notices or instructions provided by the Hotel to the Guest (hereinafter referred to as “User Guide, etc.”), such User Guide, etc. shall constitute a part of these Terms and Conditions. (Hereinafter, these Terms and Conditions, House Rules, and User Guide, etc. shall be collectively referred to as the “Terms and Conditions, etc.”).
  3. When using the services provided on the Stadium City official website and app, in addition to the Terms and Conditions, etc., the “Stadium City Members N team Terms of Service” and other terms and conditions (hereinafter collectively referred to as “Other Terms and Conditions, etc.”) shall apply. Please carefully review this Terms and Conditions, etc., and Other Terms and Conditions, etc. before using the services.
  4. Personal information of the Guest shall be handled in accordance with the “Efforts to Protect Personal Information”(https://corporate.japanet.co.jp/en/privacy/) separately stipulated.
  5. Matters not stipulated in this Terms and Conditions shall be governed by laws and regulations or generally established customs.
  6. Notwithstanding the provisions of the preceding paragraph, if the Hotel agrees to special terms and conditions that are not contrary to laws and regulations or customs, such special terms and conditions shall take precedence.

Article 2 (Application for Accommodation Contract)

  1. A person who wishes to apply for an accommodation contract with this hotel is requested to provide the following information to this hotel.
    1. Name, address, telephone number, gender, age, date of birth, etc. of guests
    2. Date of stay and estimated arrival time
    3. Accommodation charge (In principle, based on the basic accommodation charge in Appendix 1)
    4. Consent for Accommodation of a Minor" [if the person who intends to stay is a minor (under 18 years of age)].
    5. Other matters deemed necessary by the hotel
  2. In the event that a guest requests to continue his/her stay beyond the date of stay as specified in item 2 of the preceding paragraph during his/her stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made.

Article 3 (Formation of Accommodation Contract, etc.)

  1. The accommodation contract shall be concluded when this hotel accepts the application described in the preceding article (the guest after the conclusion of said contract shall hereinafter be referred to as the "guest"). (Hereinafter, the guest after the formation of said contract shall be referred to as the "Guest"). However, this shall not apply when this hotel proves that it did not give its consent, or when this hotel refuses to conclude or cancels the accommodation contract based on these Terms and Conditions, etc., even after the accommodation contract has been concluded.
  2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by this hotel within the limit of the basic accommodation charge for the period of stay shall be paid by the date designated by this hotel.
  3. The deposit shall first be applied to the room charge ultimately payable by the guest, and if a situation arises where the provisions of Article 6 apply, the deposit shall be applied in the order of penalty followed by compensation, and any remaining amount shall be returned upon payment of the charges pursuant to Article 13.
  4. In the event that the reservation deposit as stipulated in paragraph 2 is not paid by the date designated by this hotel pursuant to the provisions of said paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.
  5. If the person who intends to stay at the hotel is a minor (under 18 years of age), the application for the accommodation contract will be accepted only when the application described in the preceding article is made, or when a "written consent for accommodation of a minor" is submitted by a legal representative (parent or guardian of a minor).

Article 4 (Special clause that does not require the payment of an application fee)

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement that does not require the payment of the application fee as specified in Paragraph 2 of the preceding article after the contract is concluded.
  2. In the event that this hotel, in accepting the application for a rooming contract, does not request payment of the application fee as specified in Paragraph 2 of the preceding article, or does not specify the date by which said application fee is to be paid, it shall be deemed to have complied with the special provisions of the preceding paragraph.

Article 5 (Refusal to enter into an accommodation contract)

This hotel may refuse to enter into an accommodation contract in the following cases

  1. When there is no room available due to full occupancy
  2. When it is deemed that the person intending to stay may engage in acts that violate legal regulations, public order, or good morals in relation to their stay.
  3. When the hotel does not agree to register the application details pursuant to Article 8, Paragraph 1.
  4. When there is a false entry in the registration details pursuant to Article 8, Paragraph 1, or when there is a possibility of such false entry.
  5. When it is deemed that the person intending to stay falls under any of the following items (a) to (d):
    1. A member of a Boryokudan (organized crime group) as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Boryokudan Members, etc. (Act No. 77 of 1991) (hereinafter referred to as “Boryokudan”), a Boryokudan member as defined in Article 2, Item 6 of the same Act (hereinafter referred to as “Boryokudan member”), a quasi-member of a Boryokudan, a person related to a Boryokudan, or other anti-social forces.
    2. A corporation or other organization whose business activities are controlled by a Boryokudan or a Boryokudan member.
    3. A corporation whose officers include a Boryokudan member.
    4. When the person has engaged in acts intended to flaunt the power of a Boryokudan, etc., or to assist or promote them.
  6. When the person intending to stay is intoxicated, engages in behavior that disturbs other guests or third parties, or there is a risk of such behavior.
  7. When it is clearly recognized that the person intending to stay is a person with an infectious disease, or there is a risk of such a condition.
  8. When the person intending to stay uses violence, threats, extortion, or coercive unfair demands against the lodging facility or its staff (employees), or demands unreasonable burdens, or when it is deemed that such actions have been performed in the past, or there is a risk of such actions.
  9. When the person intending to stay is a minor (under 18 years of age) and there is no submission of a “Consent Form for Accommodation of a Minor” from the legal representative (parents, guardians, etc.).
  10. When it is impossible to accommodate the person due to natural disasters, equipment malfunctions, or other unavoidable circumstances.
  11. When the person intending to stay removes hotel property, makes requests that exceed the scope of what is socially acceptable, defames, insults, or threatens staff, or engages in harassment such as posting on SNS with the intention of causing a social media firestorm, thereby hindering the hotel’s operations, damaging the credibility and brand of the hotel or the Japanet Group, or when it is deemed that such actions have been performed in the past, or there is a risk of such actions.
  12. When the person engages in acts against public order and good morals, criminal acts, acts that violate laws and regulations, or there is a risk of such acts.
  13. When there are reasons specified by laws and regulations, guidelines established by the national government, or ordinances established by prefectures.
  14. When the person violates these Terms and Conditions or Other Terms and Conditions, etc.
  15. When the hotel deems it inappropriate for other reasons.

Article 6 (Right of Cancellation by Guests)

  1. The Guests may cancel their accommodation contract by notifying the hotel.
  2. If a guest cancels all or part of the accommodation contract due to their own responsibility (excluding cases where the hotel has requested payment of the deposit by specifying the payment deadline pursuant to Article 3, Paragraph 2 and the guest has cancelled the contract before making the payment), the hotel shall charge a cancellation fee as stipulated in Appendix 2. However, in cases where the hotel has agreed to the special conditions set forth in Article 4, Paragraph 1, this shall be limited to cases where the hotel has notified the guest about the obligation to pay a cancellation fee when the guest cancels the contract in accordance with the special conditions.
  3. If a guest fails to arrive by 11:00 PM on the day of accommodation (or 2 hours after the arrival time specified in advance if the arrival time is indicated) without contacting the hotel, the hotel may treat the accommodation contract as cancelled by the guest.
  4. The provisions of the preceding paragraphs shall not prevent the hotel from claiming damages from the guest.

Article 7 (Right of Cancellation by the Hotel)

  1. The hotel may cancel the accommodation contract in the following cases:
    1. When the conditions stipulated in Article 5 (excluding item 1) are met
    2. When the guest fails to comply with the Rules of Use stipulated in Article 10
    3. When the guest engages in prohibited activities stipulated in Article 11
    4. When the guest fails to make payment in accordance with Article 13, Paragraph 2
    5. When the guest attempts to accommodate or utilize the hotel with a number of people exceeding the number of guests stated in the accommodation application
    6. When the guest engages in dangerous acts in terms of fire prevention and disaster prevention, such as smoking in the bedroom, damaging fire equipment, etc.
    7. When the guest fails to follow the instructions of the hotel manager and staff
  2. The provisions of the preceding paragraph shall not prevent the hotel from claiming damages and cancellation fees from the guest.

Article 8 (Registration for lodging)

  1. On the day of the stay, the guest shall register the application items in accordance with Article 2 at the front desk of this hotel.
  2. When a guest intends to make payment of the charges in accordance with Article 13 by a method that can be substituted for currency, such as a credit card, the guest must present such a credit card at the time of registration in advance as described in the preceding paragraph.
  3. In addition to the provisions of these Terms and Conditions and Other Terms and Conditions, etc., we may ask you to identify yourself by presenting an official identification card.
  4. Please note that foreign guests who do not have a domicile in Japan will be required to present a copy of their passport, nationality and passport number, in addition to their name, address, occupation, etc.

Article 9 (Room usage time)

  1. Guests may use the hotel rooms from 3:00 PM on the day of arrival until 11:00 AM the following day. However, in the case of consecutive stays, the rooms may be used throughout the day except for the day of arrival and departure.
  2. Notwithstanding the provision of the preceding paragraph, the hotel may accommodate requests for using the rooms outside of the time specified in the preceding paragraph. In such cases, the following additional charges shall be applied. However, if there is no room availability, the hotel may refuse the request even if a guest makes it.
    1. Up to 3 hours beyond the designated time: 1/3 of the room charge
    2. Up to 6 hours beyond the designated time: 1/2 of the room charge
    3. 6 hours or more beyond the designated time: the full room charge

Article 10 (Compliance with the Rules of Use)

In addition to the Rules of Use, the hotel has established rules of use specific to each facility and equipment. Guests are requested to familiarize themselves with these rules in conjunction with this terms and conditions.

Article 11 (Prohibited Acts)

  1. The following activities are prohibited at the hotel
    1. Registering or providing false information when using the Hotel
    2. Acts of using the Hotel by fraudulent use of credit cards or other means of payment
    3. Unauthorized acquisition or unauthorized use of a third party's personal information, etc.
    4. Use of the Hotel for business purposes for any purpose
    5. Making and canceling a large number of reservations, or similar acts
    6. Repeatedly making and canceling lodging reservations without justifiable reason, or similar acts
    7. Any act that impersonates or misleads others into believing that it is an act of impersonation of this hotel or the Japan Net Group
    8. Illegally accessing the system or other computers, or engaging in similar acts.
    9. Transmitting or writing harmful computer programs, or engaging in similar acts.
    10. Removing the hotel’s property, making demands beyond the scope of what is socially acceptable, defaming, slandering, threatening, or harassing staff, including posting on social media with the intent of causing an online firestorm, and thereby hindering the operation of the hotel or damaging the reputation and brand of the hotel or the Japanet Group, or engaging in similar acts.
    11. Engaging in acts of violence, threats, extortion, or other coercive and unreasonable demands against the hotel or staff.
    12. Engaging in acts that may cause inconvenience, damage, or loss to other guests, third parties, the hotel, or the Japanet Group, or that may pose a risk of such acts.
    13. Infringing on the copyrights, trademarks, or other intellectual property rights, privacy rights, personality rights, or other rights of other guests, third parties, the hotel, or the Japanet Group, or engaging in acts that may pose a risk of such infringement.
    14. Engaging in acts that are against public order and morals, criminal acts, or acts that violate laws and regulations, or engaging in acts that may pose a risk of such acts.
    15. Engaging in acts of demonstrating power of organized crime groups, or aiding and abetting them.
    16. Engaging in acts that violate any other provisions of these Terms and Conditions.
    17. Engaging in acts that violate any other provisions of the Terms of Use.
    18. Engaging in any other act that we deem inappropriate.
  2. In the event that the Hotel incurs any damage as a result of the preceding paragraph, the Hotel shall be entitled to compensate the Guest for such damage.

Article 12 (Hours of operation)

Information on the hours of operation of the hotel's main facilities is available in the brochures provided, on notices posted throughout the hotel, and in the in-room service directory.

Article 13 (Payment of fees)

  1. The breakdown of accommodation charges, etc. to be paid by the guest shall be as listed in Appended Table 1.
  2. Payment of the accommodation charge, etc. as set forth in the preceding paragraph shall be made at the front desk at the time of the guest's departure or when requested by this hotel by means of a lodging voucher, credit card, etc. accepted by this hotel, or by any other method that can be substituted for such payment.
  3. In the event that the room charge settlement in the preceding paragraph is not fulfilled, the room registration, services associated with the stay, or application for an extension of the stay will not be accepted.
  4. Room charges shall apply even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for his/her use.
  5. In the event that the hotel offers a room plan that includes breakfast, lunch, dinner, or supplementary services, the hotel will charge the amount of such services even if the guest does not eat or use them.

Article 14 (Responsibility of the hotel)

  1. In the event that the hotel causes damage to a guest due to its performance or non-performance of the accommodation contract, the hotel will compensate for such damage. However, this shall not apply if the damage is not due to reasons attributable to this hotel.
  2. The hotel has Ryokan Liability Insurance to protect against fire and other emergencies.

Article 15 (Handling of cases where the contracted room cannot be provided)

  1. In the event that this hotel is unable to provide the guest with the contracted room, this hotel shall, with the consent of the guest, arrange other accommodations under the same conditions as far as possible.
  2. If, notwithstanding the provisions of the preceding paragraph, this hotel is unable to find other accommodation, it will pay the guest a compensation fee equivalent to the amount of the penalty, and the compensation fee will be applied to the amount of compensation for damages. However, if there is no reason attributable to this hotel for not being able to provide the guest room, no compensation shall be paid.

Article 16 (Handling of Deposited Goods, etc.)

  1. In the event of loss, damage or other loss of or damage to articles, cash or valuables left at the front desk by a guest, this hotel shall compensate for such damage, except in cases where such damage is caused by force majeure. However, in the event that this hotel requires the guest to disclose the type and value of cash and valuables, and the guest fails to do so, this hotel shall compensate for the damage up to 100,000 yen.
  2. In the event of loss, damage, or other damage caused by the intentional or negligent act of the hotel to articles, cash, or valuables brought into the hotel by the guest that are not left at the front desk, the hotel will compensate for such damage. However, if the type and value of the items are not specified by the guest in advance, the hotel will compensate for the damage up to 100,000 yen, except in the case of willful misconduct or gross negligence on the part of the hotel.
  3. Please note that the hotel may not accept artwork, antiques, other easily damaged items, perishable items, pets, etc. at its discretion.

Article 17 (Storage of Guest's baggage or personal belongings)

  1. If a guest's baggage arrives at the hotel prior to his/her stay, the hotel will take responsibility for keeping the baggage only if the hotel understands the baggage prior to its arrival, and will hand it over to the guest when he/she checks in at the front desk. In the event that the hotel is unable to confirm the date of stay, the name of the guest, and the reservation for the stay in advance, the hotel will refuse to accept the luggage upon arrival, or will send it back to the delivery address, etc., and will not keep it.
  2. In the event that a guest's luggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will keep them for a certain period of time, which varies depending on the nature of the item, and if the owner is not indicated during that period or is not known, the hotel will keep them for a certain period of time from the day they are found and thereafter handle them in accordance with the Lost and Found Law. After that, the lost property will be handled in accordance with the Lost and Found Law. In addition, food, beverages, magazines, and other items similar to waste, as well as items deemed by the hotel to be in accordance with general customs, will be disposed of at the hotel's discretion if the hotel is not notified by the day following check-out.
  3. In order to properly dispose of left luggage or personal belongings in accordance with the nature of their contents, this hotel may inspect their contents at its discretion and, if necessary, return them to the lost person or dispose of them in accordance with the preceding paragraph, without the guest being able to object thereto.
  4. The responsibility of this hotel for the custody of the guest's baggage or personal belongings in the case of Paragraphs 1 through 3 of the same Article shall conform to the provisions of Paragraph 2 of the preceding Article in the case of Paragraph 1, and to the provisions of Paragraph 3 of the preceding Article in the case of Paragraph 2.
  5. If a guest's baggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will, in principle, handle them in accordance with the Lost and Found Law. However, the hotel will not be held responsible for the effects of storage, including the method and location of storage and the value of the item, unless there is a reasonable cause and effect relationship between intent or negligence.

Article 18 (Responsibility for parking)

When a guest uses the parking lot of this hotel, regardless of whether or not the guest has deposited the key to the vehicle, this hotel rents the space and is not responsible for the management of the vehicle. However, in the event that damage is caused by the hotel's willful misconduct or negligence in managing the parking lot, the hotel will be held responsible for compensation.

Article 19 (Customer Responsibility)

In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.

Article 20 (Disclaimer)

The Company shall be exempted from liability in the event of any other provision of these Terms of Conditions, etc. or any other disclaimer set forth in the Other Terms and Conditions, etc..

Article 21 (Modification of these Terms and Conditions, etc.)

  1. Please note that the contents of these Terms and Conditions are subject to change without notice. Please check our official website for the latest information.
  2. The Guest's use of the Hotel after any change to these Terms and Conditions, etc., shall be deemed to constitute the customer's agreement to the changed contents.
  3. Notwithstanding the preceding paragraph, the provisions prior to the change shall apply to accommodation contracts that were concluded prior to the change of these Terms and Conditions, etc.

Article 22 (Separability)

  1. Even if any part of these Terms and Conditions or other Terms of Conditions, etc. is determined to be invalid under laws and regulations, the provisions of these Terms of Conditions and other Terms of Conditions, etc. excluding such part shall remain valid.
  2. Even if any part of these Terms of Conditions or other Terms of Conditions, etc. is invalid or revoked in relation to a customer, these Terms of Conditions and other Terms of Conditions, etc. shall remain valid in relation to all customers except such customer.

Article 23 (Governing law)

The validity, interpretation and performance of these Terms and Conditions, etc. shall be governed by the laws of Japan.

Article 24 (Preferred language)

The Japanese language shall be the official language of the Terms and Conditions and other terms of Conditions, etc. Even if there is a translation provided for your reference, only the original Japanese text shall be effective as the contract, and the translation shall have no effect whatsoever.

Article 25 (Court of competent jurisdiction)

The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes related to these Terms and Conditions, etc.

  1. % is the ratio of the penalty to the reservation amount (including tax).
  2. If the contracted number of days is shortened, a penalty fee of one day (the first day) will be collected regardless of the number of shortened days.
  3. In the event of cancellation of a contract for a part of a group (15 or more persons), 10% of the number of persons staying at the hotel 10 days prior to the date of stay (or the date of acceptance if the application is accepted after that date) (any fractional number will be rounded up) will not be subject to a penalty. No penalty will be charged for the number of guests that is less than 10% of the total number of guests (any fraction will be rounded up).
