Accommodation Clauses

第1条 (Scope of application)

  1. The accommodation contract and related agreements entered into by this hotel with the guest shall be in accordance with the provisions of these general terms and conditions.
  2. In addition to the "Stadium City Hotel Nagasaki House Use Regulations" (hereinafter referred to as the "Use Regulations"), which are separately stipulated in connection with the accommodation contract In addition to the "Terms and Conditions of Use" (hereinafter referred to as the "Terms and Conditions"), in the event that there are any other guidelines, notes, etc. (hereinafter referred to as the "Guidelines") presented to guests by the hotel, such Guidelines shall constitute a part of these Terms and Conditions. In addition to the Terms and Conditions of Use (hereinafter referred to as the "Terms and Conditions of Use"), in the event that there are any other guidelines, notes, etc. (hereinafter referred to as the "User Guide, etc.") presented by the hotel to the customer, such User Guide, etc. shall constitute a part of these Terms and Conditions. (These Terms and Conditions, Terms of Use, and User Guide, etc. are hereinafter collectively referred to as the "Terms and Conditions, etc.").
  3. In addition to these Terms and Conditions, the "Stadium City Members N team Membership Agreement" and other terms and conditions (hereinafter collectively referred to as "Other Terms and Conditions") apply to the use of the services provided on the Stadium City official website and app. Please read these Terms and Conditions and Other Terms and Conditions carefully before using the service.
  4. Customer personal information will be handled in accordance with the "Approach to Personal Information Protection" separately stipulated.
  5. Matters not provided for in these General Terms and Conditions shall be governed by laws and regulations or generally established customs.
  6. In the event that this hotel agrees to a special agreement to the extent that it does not violate laws, regulations and customs, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.

第2条 (Application for accommodation contract)

  1. A person who wishes to apply for an accommodation contract with this hotel is requested to provide the following information to this hotel.
    1. Name, address, telephone number, gender, age, date of birth, etc. of guests
    2. Date of stay and estimated time of arrival
    3. Accommodation charge (In principle, based on the basic accommodation charge in Appendix 1)
    4. Consent for Accommodation of a Minor" [if the person who intends to stay is a minor (under 18 years of age)]
    5. Other matters deemed necessary by the hotel
  2. In the event that a guest requests to continue his/her stay beyond the date of stay as specified in item 2 of the preceding paragraph during his/her stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made.

第3条 (Formation of Accommodation Contract, etc.)

  1. The accommodation contract shall be concluded when this hotel accepts the application described in the preceding article (the guest after the conclusion of said contract shall hereinafter be referred to as the "guest"). (Hereinafter, the guest after the formation of said contract shall be referred to as the "Guest"). However, this shall not apply when this hotel proves that it did not give its consent, or when this hotel refuses to conclude or cancels the accommodation contract based on these terms and conditions, etc., even after the accommodation contract has been concluded.
  2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by this hotel within the limit of the basic accommodation charge for the period of stay shall be paid by the date designated by this hotel.
  3. The deposit shall first be applied to the room charge ultimately payable by the guest, and if a situation arises where the provisions of Article 6 apply, the deposit shall be applied in the order of penalty followed by compensation, and any remaining amount shall be returned upon payment of the charges pursuant to Article 13.
  4. In the event that the reservation deposit as stipulated in paragraph 2 is not paid by the date designated by this hotel pursuant to the provisions of said paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.
  5. If the person who intends to stay at the hotel is a minor (under 18 years of age), the application for the accommodation contract will be accepted only when the application described in the preceding article is made, or when a "written consent for accommodation of a minor" is submitted by a legal representative (parent or guardian of a minor).

第4条 (Special clause that does not require the payment of an application fee)

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement that does not require the payment of the application fee as specified in Paragraph 2 of the preceding article after the contract is concluded.
  2. In the event that this hotel, in accepting the application for a rooming contract, does not request payment of the application fee as specified in Paragraph 2 of the preceding article, or does not specify the date by which said application fee is to be paid, it shall be deemed to have complied with the special provisions of the preceding paragraph.

第5条 (Refusal to enter into an accommodation contract)

This hotel may refuse to enter into an accommodation contract in the following cases

  1. When there is no room available due to full occupancy
  2. When it is recognized that the person who intends to stay at the hotel is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay.
  3. When the applicant does not respond to the registration of application items in accordance with Article 8, Paragraph 1
  4. When there is or may be a misrepresentation in the registration details in accordance with Article 8.1.
  5. When it is recognized that the person who intends to stay at the accommodation falls under any of the following items (1) through (4)
    1. Boryokudan (organized crime groups) as defined in Article 2, Item 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Groups (Law No. 77, 1991) (hereinafter referred to as "Boryokudan"). (hereinafter referred to as "Boryokudan"), Boryokudan members (hereinafter referred to as "Boryokudanin"), Boryokudan quasi-organized crime syndicates, or Boryokudan-quasi organized crime syndicates (ii) Bouryokudan (organized crime groups), quasi-constituents of Bouryokudan or persons related to Bouryokudan, and other antisocial forces.
    2. When the applicant is a Boryokudan or a juridical person or other organization whose business activities are controlled by Boryokudan or Boryokudan-in members.
    3. A juridical person whose officers fall under the category of Bouryokudan-in (organized crime group member)
    4. When the applicant has flaunted the power of a crime syndicate or other groups, or has acted in support of or in furtherance of such groups
  6. When a person who intends to stay at the hotel is intoxicated, or when he/she says or does something that causes inconvenience to other guests or third parties, or when there is a fear that he/she may be intoxicated or do something that causes inconvenience to other guests or third parties.
  7. When it is clearly recognized that the person seeking accommodation is or may be a person with an infectious disease.
  8. When a person seeking accommodation has made violent, threatening, blackmailing, or intimidating unreasonable demands of the accommodation or staff (employee) of the accommodation, or has demanded a burden exceeding a reasonable range, or has been recognized as having committed similar acts in the past, or is feared to have done so.
  9. When the person seeking accommodation is a minor (under 18 years of age) and has not submitted a "Letter of Consent for Accommodation of a Minor" by a legal representative (parent, parental authority or guardian of a minor).
  10. When we are unable to accommodate you due to natural disasters, breakdown of facilities or equipment, or other unavoidable reasons
  11. (iii) When a guest has obstructed the operation of the hotel or damaged the credibility or brand of the hotel or the Japan Net Group by demanding the removal of the hotel's equipment or by making other demands beyond the scope of socially acceptable norms, slandering, defaming, threatening, or harassing the staff, such as posting on SNS for the purpose of causing a firestorm, or when it is recognized that a similar act has been committed in the past, or there is a fear that such an act may have been committed.
  12. Any act that offends public order and morals, is criminal, violates laws or regulations, or is likely to do so.
  13. When there are laws and ordinances, national guidelines, or other reasons specified by prefectural ordinances
  14. (iii) When a user violates these Terms of Use or any other terms of use.
  15. Any other cases that the hotel deems inappropriate.

第6条 (Guest's right to cancel the contract)

  1. The guest may cancel the accommodation contract by making a request to this hotel.
  2. In the event that a guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except in the event that this hotel specifies the due date for payment of the application fee and requests payment thereof pursuant to Article 3, paragraph 2, and the guest cancels the accommodation contract prior to such payment), this hotel shall charge a penalty fee as listed in Appended Table 2. ), a penalty fee shall be charged in accordance with the provisions listed in Appended Table 2. However, in the event that this hotel accepts the special contract stipulated in Article 4, Paragraph 1, it is only when this hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in accepting such special contract.
  3. In the event that a guest does not arrive at the hotel by 11:00 p.m. on the day of stay (or 2 hours after the estimated time of arrival, if such time has been specified in advance), this hotel may deem the accommodation contract to have been cancelled by the guest.
  4. The provisions of the preceding paragraphs shall not preclude the Hotel from claiming compensation for damages from the Customer.

第7条 (The hotel's right to terminate the contract)

  1. This hotel may cancel the accommodation contract in the following cases
    1. When any of the items in Article 5 (except for Item 1) is applicable
    2. When the user does not comply with the rules of use as stipulated in Article 10.
    3. If you have committed any of the prohibited acts described in Article 11.
    4. When payment is not made in accordance with Article 13, Paragraph 2
    5. In the event that the number of guests exceeds the number of people who have applied to stay at the hotel.
    6. When a guest commits an act dangerous to fire and disaster prevention, such as smoking in his/her bedroom or damaging firefighting equipment, etc.
    7. Disobeying the instructions of the hotel's manager and staff
  2. The provisions of the preceding paragraph shall not preclude the Hotel from claiming compensation for damages and penalties from the guest.

第8条 (Registration for lodging)

  1. On the day of the stay, the guest shall register the application items in accordance with Article 2 at the front desk of this hotel.
  2. When a guest intends to make payment of the charges in accordance with Article 13 by a method that can be substituted for currency, such as a credit card, the guest must present such a credit card at the time of registration in advance as described in the preceding paragraph.
  3. In addition to the provisions of these terms and conditions and other terms and conditions of use, we may ask you to identify yourself by presenting an official identification card.
  4. Please note that foreign guests who do not have a domicile in Japan will be required to present a copy of their passport, nationality and passport number, in addition to their name, address, occupation, etc.

第9条 (Room usage time)

  1. Guests may use the rooms from 3:00 p.m. to 11:00 a.m. of the following day. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure.
  2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such cases, the following additional charges will apply. However, if there is no room available, the hotel may refuse the request even if the guest so requests.
    1. 1/3 of the room charge for up to 3 hours in excess
    2. Up to 6 hours in excess, 1/2 of the room rate
    3. Excess of 6 hours or more: full room charge

第10条 (Compliance with usage rules)

In addition to the Terms and Conditions of Use, each facility in the hotel has its own rules and regulations for use of its facilities. Guests are requested to read them in conjunction with these Terms and Conditions before using the facilities.

第11条 (Prohibited acts)

  1. The following activities are prohibited at the hotel
    1. Registering or providing false information when using the Hotel
    2. Acts of using the Hotel by fraudulent use of credit cards or other means of payment
    3. Unauthorized acquisition or unauthorized use of a third party's personal information, etc.
    4. Use of the Hotel for business purposes for any purpose
    5. Making and canceling a large number of reservations, or similar acts
    6. Repeatedly making and canceling lodging reservations without justifiable reason, or similar acts
    7. Any act that impersonates or misleads others into believing that it is an act of impersonation of this hotel or the Japan Net Group
    8. Unauthorized access to systems or other computers, or similar acts
    9. Transmitting or writing harmful computer programs, etc., or similar acts
    10. (iii) Acts that obstruct the operation of this hotel or damage the credibility or brand of this hotel or the Japan Net Group by demanding removal of the hotel's equipment or other demands beyond the scope of socially acceptable norms, slandering, defaming, or threatening our staff, or harassing our staff by posting on SNS for the purpose of creating a flame war, etc., or any similar acts. or similar acts.
    11. (2) Coercive and unreasonable demands such as violence, threats, extortion, etc. against the Hotel or its staff.
    12. Any act that causes or may cause trouble, damage or disadvantage to other guests, third parties, this hotel or the Japan Net Group.
    13. Any act that infringes or may infringe upon the copyrights, trademarks, other intellectual property rights, privacy, personal rights, or other rights of other customers, third parties, this hotel, or the Japan Net Group.
    14. Acts that are offensive to public order and morals, criminal acts, acts in violation of laws and regulations, or acts that may lead to such acts
    15. (iii) Actions that flaunt the power of organized crime groups, etc., or aid or abet them.
    16. Violation of any other provisions of these Terms of Use, etc.
    17. Other acts in violation of the Terms of Use, etc.
    18. Other activities that the Company deems inappropriate.
  2. In the event that the Hotel incurs any damage as a result of the preceding paragraph, the Hotel shall be entitled to compensate the Guest for such damage.

第12条 (Hours of operation)

Information on the hours of operation of the hotel's main facilities is available in the brochures provided, on notices posted throughout the hotel, and in the in-room service directory.

第13条 (Payment of fees)

  1. The breakdown of accommodation charges, etc. to be paid by the guest shall be as listed in Appended Table 1.
  2. Payment of the accommodation charge, etc. as set forth in the preceding paragraph shall be made at the front desk at the time of the guest's departure or when requested by this hotel by means of a lodging voucher, credit card, etc. accepted by this hotel, or by any other method that can be substituted for such payment.
  3. In the event that the room charge settlement in the preceding paragraph is not fulfilled, the room registration, services associated with the stay, or application for an extension of the stay will not be accepted.
  4. Room charges shall apply even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for his/her use.
  5. In the event that the hotel offers a room plan that includes breakfast, lunch, dinner, or supplementary services, the hotel will charge the amount of such services even if the guest does not eat or use them.

第14条 (Responsibility of the hotel)

  1. In the event that the hotel causes damage to a guest due to its performance or non-performance of the accommodation contract, the hotel will compensate for such damage. However, this shall not apply if the damage is not due to reasons attributable to this hotel.
  2. The hotel has Ryokan Liability Insurance to protect against fire and other emergencies.

第15条 (Handling of cases where the contracted room cannot be provided)

  1. In the event that this hotel is unable to provide the guest with the contracted room, this hotel shall, with the consent of the guest, arrange other accommodations under the same conditions as far as possible.
  2. If, notwithstanding the provisions of the preceding paragraph, this hotel is unable to find other accommodation, it will pay the guest a compensation fee equivalent to the amount of the penalty, and the compensation fee will be applied to the amount of compensation for damages. However, if there is no reason attributable to this hotel for not being able to provide the guest room, no compensation shall be paid.

第16条 (Handling of Deposited Property, etc.)

  1. In the event of loss, damage or other loss of or damage to articles, cash or valuables left at the front desk by a guest, this hotel shall compensate for such damage, except in cases where such damage is caused by force majeure. However, in the event that this hotel requires the guest to disclose the type and value of cash and valuables, and the guest fails to do so, this hotel shall compensate for the damage up to 100,000 yen.
  2. In the event of loss, damage, or other damage caused by the intentional or negligent act of the hotel to articles, cash, or valuables brought into the hotel by the guest that are not left at the front desk, the hotel will compensate for such damage. However, if the type and value of the items are not specified by the guest in advance, the hotel will compensate for the damage up to 100,000 yen, except in the case of willful misconduct or gross negligence on the part of the hotel.
  3. Please note that the hotel may not accept artwork, antiques, other easily damaged items, perishable items, pets, etc. at its discretion.

第17条 (Storage of your baggage or personal belongings)

  1. If a guest's baggage arrives at the hotel prior to his/her stay, the hotel will take responsibility for keeping the baggage only if the hotel understands the baggage prior to its arrival, and will hand it over to the guest when he/she checks in at the front desk. In the event that the hotel is unable to confirm the date of stay, the name of the guest, and the reservation for the stay in advance, the hotel will refuse to accept the luggage upon arrival, or will send it back to the delivery address, etc., and will not keep it.
  2. In the event that a guest's luggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will keep them for a certain period of time, which varies depending on the nature of the item, and if the owner is not indicated during that period or is not known, the hotel will keep them for a certain period of time from the day they are found and thereafter handle them in accordance with the Lost and Found Law. After that, the lost property will be handled in accordance with the Lost and Found Law. In addition, food, beverages, magazines, and other items similar to waste, as well as items deemed by the hotel to be in accordance with general customs, will be disposed of at the hotel's discretion if the hotel is not notified by the day following check-out.
  3. In order to properly dispose of left luggage or personal belongings in accordance with the nature of their contents, this hotel may inspect their contents at its discretion and, if necessary, return them to the lost person or dispose of them in accordance with the preceding paragraph, without the guest being able to object thereto.
  4. The responsibility of this hotel for the custody of the guest's baggage or personal belongings in the case of Paragraphs 1 through 3 of the same Article shall conform to the provisions of Paragraph 2 of the preceding Article in the case of Paragraph 1, and to the provisions of Paragraph 3 of the preceding Article in the case of Paragraph 2.
  5. If a guest's baggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will, in principle, handle them in accordance with the Lost and Found Law. However, the hotel will not be held responsible for the effects of storage, including the method and location of storage and the value of the item, unless there is a reasonable cause and effect relationship between intent or negligence.

第18条 (Responsibility for parking)

When a guest uses the parking lot of this hotel, regardless of whether or not the guest has deposited the key to the vehicle, this hotel rents the space and is not responsible for the management of the vehicle. However, in the event that damage is caused by the hotel's willful misconduct or negligence in managing the parking lot, the hotel will be held responsible for compensation.

第19条 (Customer Responsibility)

In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.

第20条 (Disclaimer)

The Company shall be exempted from liability in the event of any other provision of these Terms of Use, etc. or any other disclaimer set forth in the Terms of Use, etc.

第21条 (Modification of these terms and conditions, etc.)

  1. Please note that the contents of these terms and conditions are subject to change without notice. Please check our official website for the latest information.
  2. The customer's use of the Hotel after any change to these Terms and Conditions, etc., shall be deemed to constitute the customer's agreement to the changed contents.
  3. Notwithstanding the preceding paragraph, the provisions prior to the change shall apply to accommodation contracts that were concluded prior to the change of these Terms and Conditions, etc.

第22条 (Separability)

  1. Even if any part of these Terms of Use or other Terms of Use is determined to be invalid under laws and regulations, the provisions of these Terms of Use and other Terms of Use excluding such part shall remain valid.
  2. Even if any part of these Terms of Use or other Terms of Use is invalid or revoked in relation to a customer, these Terms of Use and other Terms of Use shall remain valid in relation to all customers except such customer.

第23条 (Governing law)

  1. The validity, interpretation and performance of these Terms and Conditions, etc. shall be governed by the laws of Japan.

第24条 (Preferred language)

  1. The Japanese language shall be the official language of the Terms and Conditions and other terms of use. Even if there is a translation provided for your reference, only the original Japanese text shall be effective as the contract, and the translation shall have no effect whatsoever.

第25条 (Court of competent jurisdiction)

  1. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes related to these Terms and Conditions, etc.

  2. If the contracted number of days is shortened, a penalty fee of one day (the first day) will be collected regardless of the number of shortened days.

In the event of cancellation of a contract for a part of a group (15 or more persons), 10% of the number of persons staying at the hotel 10 days prior to the date of stay (or the date of acceptance if the application is accepted after that date) (any fractional number will be rounded up) will not be subject to a penalty. No penalty will be charged for the number of guests that is less than 10% of the total number of guests (any fraction will be rounded up).
